The site is updated regularly by GIFEC. Similarly, the legal notices may be modified at any time: they are nevertheless binding on the user, who is invited to refer to them as often as possible in order to take note of them.

The purpose of the GIFEC website is to provide information about all of the company's activities.

GIFEC endeavours to provide information on the website that is as accurate as possible. However, it cannot be held responsible for omissions, inaccuracies and shortcomings in updating, whether these are its fault or the fault of third-party partners who provide it with this information. 

All information on the GIFEC website is provided for information purposes only and is subject to change. Furthermore, the information on the GIFEC website is not exhaustive. They are given subject to changes having been made since they were put online.

The website cannot be held responsible for any material damage related to the use of the website. Furthermore, the site user undertakes to access the site using recent, virus-free equipment with the last generation updated browser . 

Intellectual property

GIFEC is the owner of the intellectual property rights or holds the rights of use on all the elements accessible on the site, in particular the texts, images, graphics, logos, icons, sounds and software. 

Any reproduction, representation, modification, publication, adaptation of all or part of the elements of the site, whatever the means or the process used, is forbidden, except with the prior written authorisation of: GIFEC. 

Any unauthorised use of the site or of any of the elements it contains will be considered as constituting an infringement and will be prosecuted in accordance with the provisions of articles L.335-2 et seq. of the Intellectual Property Code. 

 

Responsibilities

GIFEC may not be held liable for any direct or indirect damage caused to the user's equipment when accessing the site and resulting either from the use of equipment that does not meet the specifications indicated in point 4 or from the appearance of a bug or incompatibility. 

GIFEC may not be held liable for any indirect damage (such as loss of market or loss of opportunity) resulting from the use of the site. 

Interactive areas (possibility to ask questions in the contact area) are available to users. GIFEC reserves the right to delete, without prior notice, any content posted in this area that contravenes the legislation applicable in France, in particular the provisions relating to data protection. Where applicable, GIFEC also reserves the right to hold the user civilly and/or criminally liable, particularly in the event of messages of a racist, insulting, defamatory or pornographic nature, regardless of the medium used (text, photographs, etc.) 

 

Personal data 

In France, personal data are notably protected by the French law n° 78-87 of January 6, 1978, law n° 2004-801 of August 6, 2004, article L. 226-13 of the Penal Code and the European Directive of October 24, 1995. 

When using the GIFEC site, the following information may be collected: the URL of the links through which the user accessed the site, the user's access provider, the user's Internet protocol (IP) address. 

In any event, GIFEC only collects personal information relating to the user for the purpose of certain services offered by the site. The user provides this information with full knowledge of the facts, particularly when he or she enters it. The user of the site is then informed whether or not he/she is required to provide this information. 

In accordance with the provisions of French articles 38 and following of the French law 78-17 of January 6, 1978, regarding information technology, files and freedoms, any user has the right to access, rectify and oppose any personal data concerning him/her, by making a written and signed request, accompanied by a copy of the identity document with the signature of the holder of the document, and specifying the address to which the reply should be sent. 

No personal information of the user of the GIFEC site is published without the user's knowledge, exchanged, transferred, ceded or sold on any medium to third parties. Only if GIFEC and its rights are purchased will the said information be transmitted to a potential buyer who will in turn be bound by the same obligation to preserve and modify the data concerning the site user. 

The databases are protected by the provisions of the French law of July 1, 1998 transposing Directive 96/9 of March 11, 1996 on the legal protection of databases.  

 

Cookies and hyperlinks  

The site contains a number of hyperlinks to other sites, set up with the permission of GIFEC. However, GIFEC does not have the possibility of checking the content of the sites visited in this way, and consequently assumes no responsibility for this.

A cookie is a small file, which does not allow the identification of the user, but which records information about the navigation of a computer on a site. The information obtained is intended to facilitate subsequent navigation on the site and is also used to measure the number of visitors to the site.

Applicable law and jurisdiction

Any dispute arising from the use of the GIFEC website is subject to French law. The competent courts in Paris have exclusive jurisdiction.
